Please read these terms and conditions carefully before using Our Service.
1. Workmanship Guarantee
1.1 Workmanship Guarantee
We stand by our work and offer a 1-year workmanship guarantee covering:
- Peeling, flaking, or improper adhesion due to application errors.
- Any issues directly caused by our preparation and staining process.
This guarantee applies only to decks that have been stripped to bare wood or were previously untreated. Due to the unpredictable adhesion of stain over previously treated surfaces, we cannot offer a warranty for decks that have been stained or painted in the past without full stripping.
2. Cancellation Policy
2.1 Cancellation Policy
To ensure our scheduling and resources are managed efficiently, we require advance notice for cancellations. Deposits are non-refundable to cover the costs associated with reserving your service and preparing materials.
2.2 Cancellation & Refund Guidelines
- Cancellations made 7+ days before the scheduled date – Deposit is fully transferable to a future booking but non-refundable.
- Cancellations made within 7 days of the scheduled date – 50% of the deposit is forfeited, with the remainder transferable to a future booking.
- Cancellations within 48 hours of the scheduled date – Deposit is fully non-refundable.
2.3 Exceptions
If a cancellation is due to extreme weather delays or unforeseen circumstances on our end, we will work with you to reschedule or credit your deposit toward a future service. By placing a deposit, you acknowledge and agree to these terms.
3. Liability & Customer Responsibilities
3.1 Customer Responsibilities Before Work Begins
- The homeowner must ensure all furniture, décor, and obstructions are removed from the deck before our arrival.
- Any pets or children must be kept away from the work area for safety.
- Water sources must be available if pressure washing is required as part of the prep process.
3.2 Property Damage Disclaimer
While we take extreme care in our work, we are not responsible for damage to plants, grass, or surrounding areas due to stain application or cleaning products. We are not liable for damage caused by pre-existing wood rot, structural instability, or prior coatings that impact the staining process.
4. Payment Terms
Final payment is due upon completion of the project unless otherwise agreed. Late payments beyond 7 days may be subject to a late fee. Accepted payment methods include e-transfer, credit card, or invoice payments.
5. Satisfaction & Dispute Resolution
If you are not satisfied with the final results, please notify us within 7 days of completion. We will assess any concerns and, if necessary, arrange for reasonable touch-ups at no extra cost if the issue falls under our workmanship guarantee. Any disputes or disagreements will be handled professionally and fairly, with the goal of resolving issues to mutual satisfaction.
6. Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to deckstaining.com, Kingston, ON.
Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

9. Termination
We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.
Upon termination, Your right to use the Service will cease immediately.
10. Limitation of Liability
The laws of the Ontario, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.
11. Disputes Resolution
If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.
12. Changes to These Terms and Conditions
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
